ArtMedDX Terms of Use

These Terms of Use (the "Terms") are an agreement between you and ArtMedDX, operated by The ArtMedDx Team, governing your access to and use of www.artmeddx.com and its related services.

1. Acceptance of These Terms

By creating an account, selecting the control that accepts these Terms, or using an ArtMedDX account feature, you agree to these Terms and acknowledge the ArtMedDX Privacy Policy. If you do not agree, do not create an account or use protected account features. Public browsing remains subject to the provisions of these Terms that apply to all visitors.

2. Eligibility

You must be at least 18 years old and legally capable of entering into these Terms to create or use an ArtMedDX account. Do not create an account on behalf of a person who does not meet these requirements.

3. Accounts and Shared Authentication

You must provide a unique username, a valid verified primary email address, and accurate account information. You are responsible for activity through your account and for protecting your sign-in methods. Notify ArtMedDX promptly if you suspect unauthorized access.

You may not sell, transfer, share, or impersonate an account, or create accounts through unauthorized automated methods.

ArtMedDX and ARTcade use a shared Clerk authentication identity. The same sign-in identity may be used with both services, and changes to shared sign-in information may affect access to both. ArtMedDX service data, permissions, and account status are managed separately unless a notice expressly says otherwise. A restriction imposed by ArtMedDX does not by itself promise or imply a particular action by ARTcade or Clerk.

4. The ArtMedDX Service

ArtMedDX provides educational and cultural material and tools concerning the relationships among art, medicine, health, illness, history, and the body. Features may include scholarly writeups, artwork images and metadata, database browsing, user-created exhibits, contributor applications, saved content, activity history, and related resources.

ArtMedDX may add, change, suspend, or discontinue features. We do not promise that any feature or item of account data will remain available indefinitely.

5. No Medical Advice

ArtMedDX is for educational, scholarly, cultural, and informational purposes only. It does not provide medical advice, diagnosis, treatment, or emergency services and does not create a clinician-patient relationship. Do not delay or disregard professional medical advice because of ArtMedDX content. Contact an appropriate emergency service if you have a medical emergency.

Medical and historical material may be incomplete, simplified, outdated, disturbing, or subject to scholarly disagreement. The service may include historical depictions or discussion of illness, injury, nudity, death, and medical practices.

6. Contributor Applications

Submitting a contributor application does not guarantee selection, employment, compensation, publication, a response, or a continuing relationship. You represent that application information is accurate and that you are entitled to provide it. Do not submit personal health information or other sensitive information. Selected contributors may be required to accept a separate contributor agreement before contributing.

Application-related communications, including acceptance or rejection, will be sent to the email address provided in the application. ArtMedDX will not request sensitive personal or medical information by email.

7. Acceptable Use

You may not:

  • violate applicable law or another person's rights;
  • infringe copyright, trademark, privacy, publicity, confidentiality, or other rights;
  • submit personal medical records or sensitive information without a lawful, reviewed basis and appropriate authorization;
  • impersonate another person or misrepresent an affiliation, credential, or source;
  • harass, threaten, exploit, discriminate against, or endanger another person;
  • upload malicious code or attempt to bypass authentication, authorization, rate limits, content visibility, or security controls;
  • scrape, crawl, or automate access except as expressly permitted by ArtMedDX or applicable law;
  • interfere with the service or another user's use of it;
  • manipulate views, likes, favorites, bookmarks, heat scores, rankings, reports, or other engagement systems;
  • submit knowingly false or abusive reports;
  • use ArtMedDX content or data to train an artificial intelligence model or build a dataset unless the applicable rights holder, license, and law permit that use; or
  • commercially exploit the service or its content without authorization from the applicable rights holder.

8. User Content and Exhibits

"User Content" means exhibit text, selections, arrangements, titles, summaries, attribution, and other material you submit, create, or publish through ArtMedDX.

You retain the ownership rights you hold in your User Content. You grant ArtMedDX a nonexclusive, worldwide, royalty-free license to host, store, reproduce, format, transmit, and display your User Content, and to permit infrastructure providers to do the same, solely as needed to operate, secure, back up, moderate, and provide ArtMedDX according to your selected visibility. This license does not authorize ArtMedDX to use your User Content to train an artificial intelligence model or to sell it as a standalone work.

The license continues while your User Content is maintained through the service. After deletion, it continues only for the limited time reasonably needed for backups, security records, legal compliance, dispute resolution, and enforcement. ArtMedDX cannot remove copies independently saved or shared by other people before deletion.

You represent that:

  • you own your User Content or have the permissions needed to submit and use it through ArtMedDX;
  • your User Content and its use through ArtMedDX do not violate law or another person's rights;
  • quotations, images, metadata, and other sources are accurately attributed and used consistently with their licenses or applicable law; and
  • your User Content does not contain personal medical records or other sensitive information that ArtMedDX has not agreed in writing to process.

Public content may be viewed, indexed, quoted, copied, or shared by others. Unlisted content may be accessed by anyone who obtains its link. Private settings restrict intended access but cannot guarantee absolute confidentiality.

9. ArtMedDX and Third-Party Content

The ArtMedDX site design, software, logo, and original materials are owned by ArtMedDX or its licensors and are protected by applicable law. Subject to these Terms, ArtMedDX grants you a limited, revocable, nonexclusive, nontransferable right to access the service for personal, educational, and scholarly use.

Individual artworks, reproductions, writeups, quotations, metadata, and source materials may be owned by contributors, museums, archives, artists, estates, publishers, or other rights holders, or may be in the public domain. Rights and attribution information attached to an item controls over any general description in these Terms. Access through ArtMedDX does not transfer ownership or grant rights beyond the applicable license and law.

Links to Clerk, Google, MediaWiki resources, museums, archives, libraries, videos, articles, and other independent services are provided for convenience or attribution. ArtMedDX does not control and is not responsible for their content, availability, terms, or privacy practices.

10. Copyright Complaints

If you believe material on ArtMedDX infringes a copyright you own or are authorized to enforce, email artmeddxwriteups@gmail.com with:

  • identification of the copyrighted work;
  • the location and description of the challenged ArtMedDX material;
  • your name and contact information;
  • a statement that you have a good-faith belief the use is not authorized by the rights holder, its agent, or law;
  • a statement that the information in your notice is accurate and that you are the rights holder or authorized to act for the rights holder; and
  • your physical or electronic signature.

ArtMedDX may request additional information, remove or restrict material while reviewing a complaint, and provide the complaint to the affected contributor. This contact information does not represent that ArtMedDX has registered a designated agent under the Digital Millennium Copyright Act.

11. Moderation and Enforcement

ArtMedDX may review, reject, restrict, unlist, quarantine, remove, or restore User Content and may investigate reports. We do not promise to monitor all content or resolve every dispute. We may act without advance notice when reasonably necessary to address security, legal, safety, rights, or service integrity concerns.

Accounts suspected of creating or distributing malicious, unlawful, inappropriate, or otherwise prohibited content may be quarantined while the matter is reviewed. Depending on severity, enforcement may include permanent loss of access to ArtMedDX. ArtMedDX may refer suspected unlawful conduct or urgent threats to the appropriate authorities.

12. Saved Content and Feature Availability

Likes (favorites), saves (bookmarks), history, exhibit drafts, and other account features are conveniences, not permanent storage. Keep independent copies of material you cannot afford to lose. ArtMedDX does not guarantee recovery of deleted or unavailable data.

13. Suspension, Termination, and Deletion

You may stop using ArtMedDX at any time and may request deletion as described in the Privacy Policy. ArtMedDX may restrict, suspend, or terminate access for a violation of these Terms, a security risk, legal compliance, harm to another person, misuse of the service, or discontinuation of a feature or the service.

Account restrictions may make User Content unavailable. ArtMedDX may retain limited policy acceptance, security, deletion, moderation, fraud-prevention, or legal records after termination where reasonably necessary. Sections that by their nature should continue after termination, including provisions about ownership, licenses for retained copies, disclaimers, and enforcement, remain in effect.

You may appeal an ArtMedDX suspension or termination by contacting artmeddxwriteups@gmail.com. Because ArtMedDX and ARTcade use a shared sign-in identity but maintain separate service data and account states, an ArtMedDX enforcement action does not automatically represent an ARTcade enforcement decision.

14. Privacy

The ArtMedDX Privacy Policy explains how personal information is processed. Acknowledging the Privacy Policy confirms that you received and reviewed the notice; it is not blanket consent to unrelated or optional processing.

15. Disclaimers

To the extent permitted by law, ArtMedDX is provided on an "as is" and "as available" basis. ArtMedDX does not guarantee that the service will be uninterrupted, error-free, secure, complete, current, or suitable for a particular purpose. User and third-party content represents its authors or sources and is not necessarily endorsed by ArtMedDX.

ArtMedDX is a living database. Artwork records, images, metadata, and writeups may be corrected, expanded, replaced, or removed as research continues and the collection is refined.

Nothing in these Terms excludes a warranty or right that applicable law does not permit ArtMedDX to exclude.

16. Limitation of Liability

To the extent permitted by law, ArtMedDX and its operators, administrators, and contributors are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, opportunities, or profits, arising from use of or inability to use the service. This limitation does not apply where liability cannot lawfully be limited, including where applicable law provides otherwise for fraud, gross negligence, willful misconduct, personal injury, or violation of nonwaivable rights.

17. Changes to These Terms

ArtMedDX may update these Terms as the service changes. We will publish the updated effective date and version and provide any additional notice required by law. When renewed acceptance is required, you will be notified when you next access your account, and protected account features will remain unavailable until you review and accept the new version. Material changes may also be communicated by email.

18. Miscellaneous

If a provision of these Terms is found unenforceable, the remaining provisions remain in effect to the extent permitted by law. A delay in enforcing a provision is not a waiver. You may not assign your account or rights under these Terms without ArtMedDX's permission. Headings are for convenience and do not change the meaning of these Terms.
